Niels Frank

Niels’ academic foundation in economics was built upon studies at the University of Hamburg and the Christian-Albrechts-Universität Kiel, where he specialized in industrial organization. This rigorous training provided him with the theoretical framework for his subsequent extensive career in antitrust.

Over the past two decades, Niels has accumulated significant practical experience by working on a wide array of antitrust cases. His expertise encompasses the intricate assessment of cartel damages in various sectors, including cement, car glass, TV advertising, sugar, trucks, and ethylene. Furthermore, he has been involved in evaluating the competitive effects of both horizontal and non-horizontal mergers, notably as a third party in the Telefónica/E-Plus transaction. His experience also extends to abuse of dominance cases, where he has analyzed issues such as conditional rebates, bundling strategies, and access to essential facilities.

Niels’ industry exposure is broad and diverse, spanning fast-moving consumer goods, TV advertising, retailing, construction materials, business insurance, paper wholesale, airport infrastructure, telecommunication, and services related to the postal sector. This extensive industry knowledge allows him to bring a nuanced and practical perspective to his antitrust analyses.

A significant aspect of Niels’ professional activities involves acting as a party expert in court proceedings. He frequently provides both written and oral expert statements, lending his economic expertise to legal disputes. Currently, in 2025, he is serving as the claimants’ expert in the UK’s “second wave truck proceedings” before the Competition Appeal Tribunal (CAT). In this role, he is addressing complex issues such as umbrella damages, resale pass-on, truck-dependent services pass-on, and supply pass-on by local authorities.

Niels’ contributions to the field of competition economics are also reflected in his extensive publications in leading academic journals. His work has appeared in the Journal of Competition Law and Economics, the Journal of European Competition Law and Practice, the Journal of Regulatory Economics, Zeitschrift für Wettbewerbsrecht (Journal of Competition Law), and Wirtschaft und Wettbewerb (Competition Law and Economics).

In addition to his practical and scholarly pursuits, Niels has also been actively involved in academia. Between 2007 and 2021, he lectured on competition economics and competition policy at the University of Bayreuth in Germany, contributing to the education of future professionals in the field. He is also a board member of the Competition Litigation Forum e.V., further demonstrating his commitment to the development of competition law and economics.

Niels’ expertise and thought leadership in competition economics have consistently been recognized by the legal and economic communities. Lexology/Who’s Who Legal has repeatedly acknowledged him as a thought leader in the field. Furthermore, in 2023, Juve, a prominent German legal news outlet, ranked him third among the top 20 most renowned competition economists in Germany, underscoring his significant standing in the profession.
